审查调查场域中隐私权保护问题探究

Research on privacy right protection in the process of inspectionand investigation

《中华人民共和国民法典》已于2021年1月1日起施行,其亮点之一是人格权单独成编,而隐私权和个人信息保护在其中又独立成章,重要性不言而喻。个人信息等隐私权受侵犯情形,较多发生于日常生产生活中。但对于纪律审查监察调查这一特定场域,被审查调查对象隐私权保护问题无疑尤其值得探究。当前审查调查过程中,隐私权保护主要面临概念边界模糊、操作自由度大、权利救济乏力三重困境。应通过理性平衡审查调查与隐私权保护彼此之间的张力,从廓清概念内涵与外延、规范程序和理性操作、强化监督和司法救济三个方面,追问和完善审查调查规范的应有意蕴,并为探索党内法规与国家法律紧密衔接提供新的面向。

The Civil Code of the People’s Republic of China has been in enforcement since January 1,2021. As one of the highlights, the personality right appears as separate compilation. And especially, as an important signal of strengthening the protection of privacy right and personal information, they appear as independent chapters in this compilation. Normally, privacy right is violated in daily life and work, but in the special field of discipline inspection and supervision investigation, the corresponding research related to privacy right on the respondent is of great importance. In the real procession of inspection and investigation referring with privacy right protection, there are triple dilemmas such as ambivalent conception and border,much free operation space, and lack of right remedy. Therefore, we should rationally balance the tension between the censorship investigation and the protection of privacy rights, ask and perfect the due meaning of the censorship investigation norms from the three aspects of clarifying the connotation and extension of concepts,standardizing procedures and rational operation, strengthening supervision and judicial relief, so as to provide a new orientation for exploring the close connection between inner-Party regulations and national laws.
