临床医学研究生除了掌握医疗知识外,迫切需要提高基本法律知识储备。对高等院校法律素养培养进行探讨,从日常生活中、临床医疗实践层面和立法现状角度分析培养临床医学研究生法律素质必要性;明确临床医学研究生法律素质培养现状及存在不足主要集中于缺乏课程教材、教师人才缺失和学科建设不足等方面;可以通过以“以法律为准绳”“以证据为基础”和“以程序为前提”建立临床医学研究生法律思维;基于此,提高大学生法律素养的主要途径是:首先,高校法律教育要回归重在素养的本位;其次,法律文明要对行为习惯起到培育作用;再次,法律环境要形成无所不在的外部约束。可以通过开设医事法课程、开展小组研讨、阅读法学经典和组织实践教学等多项举措建立临床医学研究生法律思维并加强法律素质培养,重视医学法律教育。

In addition to mastering medical knowledge,clinical medicine graduate students urgently need to improve their basic legal knowledge reserves.Discuss the cultivation of legal literacy in colleges and universities,analyze the necessity of cultivating the legal literacy of clinical medicine graduate students from the perspective of daily life,clinical medical practice and the current legislative situation;clarify the current status of legal literacy cultivation of clinical medicine graduate students and the existing shortcomings mainly focus on the lack of courses,the lack of teaching materials,teacher talents,and the lack of discipline construction;the legal thinking of postgraduates in clinical medicine can be established by taking"law as the criterion""evidence-based"and"procedural-based"in clinical medicine;The main ways to improve the legal literacy of college students are:first,the legal education of colleges and universities should return to the standard of literacy;second,the legal civilization should play a role in cultivating behavior and habits;third,the legal environment should form ubiquitous external constraints.It is possible to establish medical law courses,conduct group discussions,read legal classics and organize practical teaching to establish the legal thinking of clinical medicine graduate students and strengthen the cultivation of legal quality,and attach importance to medical legal education.
