About Judging the Novelty and Inventivity of Claims Defined by Features of Performance and Parameter

对于产品型权利要求,基于准确清楚定义专利权的保护范围的考虑,通常采用结构组成特征来限定,当难以用结构组成特征来界定时,可以使用性能参数特征予以表征。性能参数相关基础事实的推演和经验法则的不同,将影响产品的新颖性和创造性的判断。本研究试从推定基础事实的准确性、基础事实和推断事实之间的常态性联系两个方面进行探讨,分析性能参数限定权利要求的表述特点,并通过具体复审案例从上述两个方面阐述性能参数限定权利要求的新颖性和创造性的评判思路,为专利授权和确权实践中的相关判断和处理提供参考。

In view of defining the extent of patent protection sought for in a clear and concise manner,product claims are generally defined by features of structure and/or component,where one or more technical features of a product claim cannot be clearly defined by features of structure and/or component,it is allowed to define the technical features by virtue of features of performance and parameter,the difference of the establishment of basic fact and rule of thumb will affect the determination of novelty and inventivity.This article attempts to discuss the presumption of novelty in two aspects,one is accuracy of presumption of basic fact,the other is the normal connection between basic fact and putative fact.This article analyzes the description characteristics of claims defined by performance and parameters,and cites reexamination cases to demonstrate the examination thoughts and consideration angles from aforementioned two aspects,in the hope of providing a reference in judging the novelty and inventivity in the procedure of patent licensing and patent confirmation.
