农民合作社规范发展中政府扶持的法治困境与出路

The Rule of Law Dilemma and Outlet for Government Support in the Normative Development of Peasant Cooperatives

政府扶持农民合作社是必要的,但政府扶持须遵循法治化要求确保农民合作社规范发展。在现有法律体系中,政府扶持农民合作社的准入标准、农民合作社的登记管理制度以及对政府扶持行为的监督等方面的规定不足,制约了农民合作社政府扶持制度功能的有效发挥。因此,促进农民合作社规范发展的法治出路,即在于通过法治完善政府扶持制度,一是明确政府扶持的农民合作社规范属性,二是完善政府扶持农民合作社的监管制度,三是健全政府执行农民合作社扶持措施的监督机制。

While it is necessary for the government to support peasant cooperatives, it must follow the rule of law to ensure standardized development. In the existing legal system, the regulation of admittance standard,registration management system and supervision of government support behavior to farmer cooperatives are insufficient, which restrict the effective play of government support system function for farmer cooperatives.Therefore, the way to promote the standardized development of farmers’ cooperatives is to improve the government support system through the rule of law. First, the standard attribute should be clarified. Second, the supervision system should be improved. Third, the supervision mechanism should be perfected.
