The Spirit of Traditional Law Culture Embodied in the Civil Code of the People’s Republic of China

不同民族国家因固有文化观念的差异,都会整合出不同的民法典模式。《中华人民共和国民法典》汲取了中国传统法律文化的精粹,借鉴世界各国的立法经验,顺应时代的发展而制成颁行,充分体现了中国传统法律文化的精神。作为新时代国家治理的基本遵循,《中华人民共和国民法典》承接传统法文化中“一元和合”、“实益均衡”和“顺时为是”的精神指引,明确了职权与权利间的基本规则,编定了形式权利与实质权利、形式正义与实体正义相一致的民事规范,并在制颁过程中因时顺势而创制更新,充分彰显了我国在新时代的法文化自觉与自信,也为全球治理贡献了中国智慧和中国方案。

Different nation-states will integrate different civil code models because of differences in their inherent cultural concepts.The Civil Code of the People’s Republic of China draws on the essence of traditional Chinese legal culture,learns from legislative experience of various countries in the world,and is formulated and promulgated in accordance with the development of the times,which fully reflects the spirit of traditional Chinese legal culture.As the fundamental law of state governance in the new era,the Civil Code of the People’s Republic of China undertakes the spiritual guidance of“Univariate harmony”,“beneficial balance”and“adapting to the situation”in traditional legal culture,clarified the basic rules between powers and rights,formulated civil norms consistent with formal rights and substantive rights,formal justice and substantive justice,and created and updated them in the process of making and issuing,which fully demonstrates China’s legal cultural consciousness and self-confidence in the new development stage,and also contributes Chinese wisdom and Chinese solutions to global governance.
