The Social Governance Law and Its Principle Construction in Xi Jinping’s Legal Thought

习近平法治思想对社会治理问题的关注有逐渐深入、成型的过程。治理理论在西方形成时的背景和知识积淀对我国治理概念的界定有一定的影响。习近平法治思想中的社会治理具有中国语境和特色,对其内涵界定可以从主体、内容、手段、结果四个方面展开。对习近平法治思想中的社会治理法的内涵描述,则可从法律体系、主体和手段的变革、目标与任务等方面进行。习近平法治思想中的社会治理法推行需要秉持相应的原则,具体表现为坚持全面贯彻习近平法治思想的核心要义,以中国共产党领导下的依宪治国理政与多元主体共治相结合、分散式治理与系统性治理相结合、刚性治理与柔性治理相结合、治理权和治理责任相结合的原则,以此推动社会治理法治化现代化建设,进而为全面实现国家治理体系和治理能力现代化服务。

Xi Jinping’s legal thought has gradually deepened and formed a process of attention to social governance issues.The background and knowledge accumulation when governance theory was formed in the West have a certain influence on the definition of governance concept in my country.The social governance in Xi Jinping’s legal thought has Chinese context and characteristics,and its connotation can be defined from four aspects:subject,content,means and result.The description of the connotation of the social governance law in Xi Jinping’s legal thought can be carried out in terms of the adjustment object,the legal system,the transformation of the subject and means,the goal and the task.The implementation of the social governance law in Xi Jinping’s legal thought needs to uphold the corresponding principles,which is manifested in the full implementation of the core elements of Xi Jinping’s legal thought,combining"constitutional Party-guided governance"with multi-subject co-governance,decentralized governance and systemicity the principles of combining governance,combining rigid governance with flexible governance,and combining governance rights and governance responsibilities,in order to promote the legalization and modernization of social governance,and thus to fully realize the modernization services for national governance systems and governance capabilities.
