摘要
“反向教导”是创造性审查中的重要考量因素,其会直接影响最接近现有技术能否成为得到发明的最佳起点。本文结合实际案例中争辩反向教导的常见情形,从正反两个方面对最接近现有技术是否存在反向教导进行探讨评判,以期为类似案件的处理提供一定借鉴和参考。
In the creative examination of the patent application,"teaching away"is a crucial consideration,which directly affects whether the closest prior technology can become the best invention of starting point.Combined with the common situations of arguing"teaching away"in actual cases,this paper hopes to discuss and judge whether there is"teaching away"for the closest prior technology from both positive and negative aspects,in order to provide some reference for the treatment of similar cases.
