Research on Regulation Transformation under Financial Technology Risks

金融科技是数字经济背景下金融行业发展的新方向。金融科技本质上是金融业的突破性创新,能够推进金融中介机构重构、金融商业应用模式创新以及提升金融服务效率。首先,文章分析了金融科技发展存在的数据安全、网络安全、技术及监管等具体风险。其次,基于金融科技的快速发展,监管原则应向适应性、包容性、实验性及协同性等方面转型。再次,在原则转型的情况下,明确监管科技的适用范围,并逐步推进数据标准的统一、数据共享范围的扩大、防范“反监管科技”趋向及技术陷阱。最后,为了推进监管科技的发展及应用,我国应丰富监管政策及手段体系,建立实验性和包容性监管制度,完善监管科技的技术规范及协同机制。

Financial technology is a new direction of financial industry development under the background of digital economy.Fintech can promote the reconstruction of financial intermediary institutions,the innovation of financial business application mode and the improvement of financial service efficiency,which is essentially a breakthrough innovation in the financial industry.Firstly,this paper analyzes the risks of data security,network security,technology,and supervision in the development of financial science and technology.Secondly,based on the rapid development of fintech,regulation principles should be shifted towards adaptability,inclusiveness,experimentation and collaboration.In addition,defining the scope of regulatory technology based on the transformation of principles,the unification of data standards and the expansion of data sharing scope should be gradually promoted to prevent the trend of“anti-regulatory technology”and technical traps.Finally,to promote the development and application of regulation science and technology,China should enrich the regulatory policy and means,establish experimental and inclusive regulatory system,as well as improve the technical standards and coordination mechanism of regulatory science and technology.
