Patent Licensing Governance Path Under Open Innovation——Judgment Based on Grounded Theory

随着创新边界的开放化,专利管理的规则变得愈加模糊和非适切,为探究开放式创新下的专利许可影响因素,拓展质性视角下的专利许可因素建构,文章运用扎根理论的研究范式,通过文献资料与深度访谈的结合,进行开放性编码、主轴编码和选择性编码的三级编码处理,深入挖掘开放式创新下的专利许可影响因素。根据扎根理论的范畴体系得出,主范畴包含环境因素、市场许可需求、专利管理平台、专利许可渠道四个因素,四个主范畴因素分别作为核心范畴因素的因果条件、中介条件、行动/互动策略影响着专利许可的路径建构。

With the opening up of innovation boundaries, the rules of patent management have become increasingly vague and inappropriate. In order to explore the influencing factors of patent licensing under open innovation, and to expand the construction of patent licensing factors from a qualitative perspective,the article uses the research paradigm of grounded theory, through the combination of literature data and indepth interviews, carries out the three-level coding process of open coding, main axis coding and selective coding, and deeply explores the influencing factors of patent licensing under open innovation. According to the category system of grounded theory, the main category includes four factors: environmental factors,market licensing requirements, patent management platforms, and patent licensing channels, the four main category factors, respectively, as the core category factors, are causal conditions, intermediary conditions,and action/interaction strategies that affect the path construction of patent licensing.
