论地方性法规“不重复上位法”原则的规则化

On Regularization of the Principle of Local Laws and Regulations’ “Not Repeating Higher-level Law”

“不重复上位法”原则的规则化是依法治理地方性法规重复上位法的落脚点。然而数据分析和立法文本表明,地方立法规范明显存在对“不重复上位法”原则的弱回应性。依循“需求—供给”的逻辑框架,“不重复上位法”原则的规则化面临着地方重复立法需求对规则化的反向作用、地方对原则的识别困难阻碍规则化进程、地方未实现原则的技术规则法律化改造等主要困境。为推动“不重复上位法”原则的规则化,一方面应强化原则对地方重复立法的约束能力,明确原则的规范阐释和制度建设指引,另一方面还应加快原则的技术规则法制化和体系化。

The regularization of the principle of“non-repetition of higher-level laws”is the foothold of governing local regulations’repetition with the higher-level law.However,data analysis and legislative texts show that local legislative norms obviously have weak responsiveness to the principle of“non-repetition of higher-level laws”.Following the logical framework of“demand-supply”,the regularization of the principle of“non-repetition of higher-level laws”faces some major dilemmas:the reverse effect from local demands of repetitive legislation,the difficulty of local recognition of principles hindering the process of regularization,and unfulfilled legal adaptation of principle’s technical rules.In order to promote the regularization of the principle of“non-repetition of higher-level laws”,on the one hand,it is necessary to strengthen the principle’s ability to restrict local repetitive legislation and to clarify the normative interpretation of the principle and the guidance of system construction,and on the other hand,to accelerate the legalization and systematization of the principle’s technical rules.
