论党内试验性立规的制度功能及其增进

党内试验性立规是党内法规制定实践中经常采用的一种立规机制,包括“暂行类”和“试行类”两种体例。党内试验性法规调整范围较广,但以党员领导干部的行为为主。规则填补和探索检验是党内试验性立规的两项基本制度功能。党内法规制定条例只规定规则填补功能的做法值得商榷。以科学立规的要求审视,党内试验性立规存在着一些问题,包括适用条件的规定不够明确合理、缺乏试验期限的规定以及缺少试验期满后的处置机制。对此,需要从制度上明确“暂行类”和“试行类”两种试验性立规各自的适用条件,建立党内试验性立规同党的政策衔接机制,设置“日落条款”并健全处置机制等,以更好地发挥党内试验性立规的制度功能,尤其要突出发挥其面向未来的探索检验功能。

Partypilot regulation-making is one of the common regulation-making mechanisms in the practice of the enacting of party regulations which contains Temporary and Trial models.The adjustment range of party pilot regulation-making is wide but mainly refers to the actions of the party leaders.Rule filling and exploring-testing are two fundamental functions of party pilot regulation-making.It is worthy to discuss that only the function of rule filling is set by the Regulation of Party-regulation Making.If we look into the requirements of the scientific regulation-making,there are some problems in the process of party pilot regulation-making,such as the ambiguity and irrationality of the clause about the application conditions,and the lack of pilot duration and disposal mechanisms after the end of pilot.Therefore,it is necessary to make clear the application conditions of temporary and trial regulation-making,to establish the cohesive mechanisms between the party experimental regulation-making and party policies,and to set up the sunset clause and perfect the disposal mechanisms,in order to make the party pilot regulation-making functions work better and especially to realizeits explorative and testing function.
