The Problem and Improvement Measures of the Right of Informed Consent for Patients in China

立足于我国现有的法律法规,阐述我国现阶段患者知情同意权在代为行使过程中出现的患者知情同意权主体混乱、患者与代为行使人之间的利益冲突被忽略等问题,并提出了相应的解决措施,以此确立患者的最佳利益,为现阶段我国推进医患关系的良性发展提供深层次的保障。

Based on the existing laws and regulations of our country,this paper expounds the problems existing in the exercise of the right of informed consent of patients in the present stage of our country,such as the confusion of the subjects of the right of informed consent of patients,the neglect of the conflicts of interests between patients and the agent,etc.,to establish the best interests of patients,for the current stage of our country to promote the benign development of doctor-patient relationship to provide a deep layer of protection.
