我国翻译行业立法要件分析及立法建议

An Analysis of Essential Elements of Translation Industry Legislation in China and Some Legislative Suggestions

翻译行业的健康发展不仅需要严格的行业自律,更需要通过立法强化他律。通过考察我国现有与翻译有关的法律法规制定情况,调查翻译相关法律纠纷的司法现状,笔者发现,翻译行业立法缺位已经成为制约行业发展的主要瓶颈。据此,本文尝试从法律关系构成三要素入手分析翻译行业立法要件,就翻译市场资格准入、翻译活动主体权利与义务、翻译服务规范、翻译产品质量标准以及翻译协会职能等话题展开论述,进而从翻译行业立法的内容和路径两个方面提出具体建议。

The healthy development of translation industry requires not only better professional autonomy,but also stronger heteronomy through legislation.By investigating the status quo of Chinese laws and regulations relevant to the translation industry and the judicial operation of translation-related disputes in China,this study finds out that the absence of legislation has become a major bottleneck for the development of translation industry.On such basis,this article provides an analysis of legislation for the translation industry on the theoretical basis of the three elements of legal relationship.Discussion centers on topics such as qualifications,rights and obligations in the translation business,specifications and quality standards for translation services,and functions of translation associations,based on which specific suggestions are made in terms of the contents of and the path to translation industry legislation in China.
