国际化营商环境视域下外商投资服务法治保障体系的构建——以河南自贸区为例

Construction of Foreign Investment Service System in Free Trade Zone from the Perspective of International Business Environment: Taking China(Henan) PILOTFTZ as an Example

国际化是优化营商环境建设的核心目标,国际化的营商环境需要对标高标准经贸规则,并以法治化为基本路径。国际化营商环境视域下外商投资服务体系的构建有三个基本标准,即以对标高水平国际投资规则为基本要求,以法治化为构建路径,以多元结合的服务体系为内容。河南自贸区针对外商投资服务体系建设中存在的问题,通过地方法规的制定实现了初步的法治化,但仍存在不足。需要通过进一步制定具体化规则和细化立法、并制定地方立法性质的“外商投资条例”,实现对外商投资服务体系的进一步构建。

Internationalization is the core goal of optimizing the construction of business environment. The international business environment needs to improve the standard economic and trade rules and take the rule of law as the basic path. There are three basic standards for the construction of foreign investment service system from the perspective of international business environment, that is, taking the elevation level international investment rules as the basic requirements and the rule of law as the construction path, which is the multiple combination of universal services and special services. Aiming at the problems existing in the construction of foreign investment service system, Henan free trade zone has realized the preliminary legalization through the formulation of local laws and regulations, but there are still deficiencies. It is necessary to further construct the foreign investment service system by further formulating specific rules and mechanisms, refining legislation, and formulating local legislative regulations on foreign investment.
