Environmental Standards in Environmental Laws:Taking Legal Texts as the Object of Analysis

立足法律文本,本文讨论环境法引进环境标准的法理和方式,并揭示环境标准在环境法中的地位与作用。环境法引进环境标准的法理在于标准化可为法律关系的调整提供更为具体的、可操作的、科学的依据。环境法多以转介的方式引进环境标准,型塑了“原则+规则+标准”的规范结构。在环境法中,环境标准具有技术支撑地位,产生良法善治作用。

Based on the legal texts,this paper discusses the legal principles and methods of introducing environmental standards into environmental laws,and reveals the status and role of environmental standards in environmental laws.The jurisprudence of the introduction of environmental standards into the environmental law is that standardization can provide a more specific,operable and scientific basis for the adjustment of legal relations.Environmental laws mostly introduce environmental standards through referrals,shaping the normative structure of"principles+rules+standards".In environmental laws,environmental standards have the status of technical support and produce good laws and good governance.
