海警机构海上维权执法协作的问题与规制

Problems and Regulations of Coordination on Maritime Rights Protection and Law Enforcement in Coast Police Agencies

《海警法》第59条确立了海警机构海上维权执法协作机制。海警机构与其他部门在海上维权执法方面的有效协作,不仅有助于提升我国海洋治理能力的现代化水平,也有利于维护国家主权和海洋权益。当前,海上维权执法机构之间的协作在执法目标、管辖区域、执法权限、回应过程等方面存在一些不协调的问题。上述问题产生的主要原因在于:缺少常设协作机构,单向性协作存在行动阻碍,部门本位制约,配套机制供给不足等。有鉴于此,应当坚持法治原则,适时组建涉海综合协调机构,构建双向协作机制,完善配套的程序机制,从而有效提升海上维权执法协作水平,加快海洋强国建设。

Article 59 of Coast Police Law has established coordination mechanism for maritime rights protection and law enforcement.Effective coordination between coast police agency and other agencies in maritime rights protection and law enforcement is not only conducive to modernization of China's maritime governance capacity,but also helps to safeguard national sovereignty and maritime rights and interests.Currently,there are some uncoordinated problems in coordination between law enforcement agencies for maritime rights protection in terms of law enforcement objectives,jurisdiction,law enforcement authority and response process,etc.The main reasons for the above problems are:lack of permanent coordination organization,existence of action hindrance in unidirectional coordination,departmental standard restriction,insufficient supply of supporting mechanism and so on.In view of this,we should adhere to the rule of law,establish a comprehensive maritime coordination agency at an appropriate time,establish a two-way coordination mechanism,and improve supporting procedures and mechanisms,so as to effectively improve coordination on maritime rights protection and law enforcement and speed up efforts to build China into a maritime power.
