公共文化服务立法的实践场景:国家与地方互动视角

The Implementation of Public Cultural Service Legislations:From the Perspective of Interactions between National and Local Levels

公共文化服务立法是完善公共文化服务体系的基石,已有研究侧重于对《公共文化服务保障法》文本内容解读及地方性立法进展的梳理,缺乏对公共文化服务立法实践进行历时性与共时性的整体考察。文章基于国家与地方互动视角,从国家与地方的双向互动实践出发,探讨新时代公共文化服务立法实践的特色场景。公共文化服务立法实践在历时性上具有从地方先行试点到国家普遍实施再到地方特色彰显的特征,在共时性上具有国家执法检查与地方共抓落实的特征。而在公共文化服务立法实践中又遇到文化和旅游融合、新冠肺炎疫情暴发、国家文化安全、高质量发展等新情况,地方立法迅速总结经验并吸纳,这些又为国家公共文化服务立法的修订提供了时空条件。公共文化服务立法实践场景中国家与地方的互动促进了公共文化服务提质增效,是健全现代公共文化服务体系的重要路向。

Public cultural service legislations are the cornerstone for improving the public cultural service system.Existing studies mainly focus on the interpretation of legal text and combing the progress of local legislations. There is a lack of comprehensive investigation of the practice of public cultural services diachronically and synchronically.Based on the perspective of interactions between national and local levels,this paper discusses the scenarios of China’s public cultural service legislative practices in the new era. This paper puts forward that the legislative practices of public cultural services have diachronic characteristics,i.e.,from local pilot projects to national implementation incorporated local characteristics,and synchronic characteristics of national monitoring measures and local implementation measures. In face of the new coronavirus,local legislations have quickly summed up the experience and effectively accommodated new situations of integration of culture and tourism, pandemic outbreak, national cultural safety and high-quality development. The interactions between state and local governments in the legislative practices of public cultural services have not only promoted the improvement of quality and efficiency of public cultural services,but also been continuously improving the building of modern public cultural service system.
