涉及城轨占地的已开发国有土地使用权公益性收回补偿问题研究

Research on compensation for public welfare reclaim of use rights of developed state-owned land involving urban rail transit land occupation

在城市轨道交通工程前期工作中,收回部分已开发国有土地的使用权是一项非常重要的任务,这涉及到对已开发国有土地使用权的公益性收回补偿。为提高补偿的合理性、公平性和可接受性,有力推动城市轨道交通建设征地动迁工作的顺利开展,文章通过梳理目前已开发国有土地使用权公益性收回补偿中存在的问题,提出从部分土地使用权收回对原土地价值的影响和被收回土地本身的开发价值2个角度着手进行补偿评估的思路,希望为国内相关实践提供参考和借鉴。

In the preliminary work of urban rail transit project,the reclaim of the use rights of developed state-owned land is a very important task,which involves public welfare reclaim compensation for use rights of the developed state-owned land.In order to improve rationality,fairness and acceptability of those compensations,and support smooth development of land acquisition and relocation for urban rail transit construction,this paper proposes the idea of compensation evaluation from the impact of reclaim of use rights of land on the original land value and from the development value of the reclaimed land itself.Through sorting out current issues in compensation for public welfare reclaim of use rights of state-owned land,this paper hopes to provide reference for relevant domestic practices.
