损毁农作物是一种侵犯财产罪,根据《中华人民共和国刑法》第二百七十六条规定对施害人应当以破坏生产经营罪进行定罪和量刑,根据最高人民检察院、公安部《关于公安机关管辖的刑事案件立案追诉标准的规定(一)》(公通字[2008]36号)第三十四条立案追诉;对于达不到刑事立案标准的,根据《中华人民共和国治安管理处罚法》第四十九条规定追究施害人治安责任。同时,施害人还要承担相应民事赔偿责任。本文以三起农作物疑似被人施用农药进行损毁案件的发生发展情况为案例,提出农业农村部门应当受理“被害人”的田间现场鉴定申请,建议免收鉴定费,组织3个以上相关专业副高级职称以上专业技术人员组成专家鉴定组及时、科学地开展鉴定,客观、公正、实事求是地做出鉴定结论,鉴定结论要有准确性,鉴定报告要有时效性、权威性。
