《最高人民法院关于审理行政赔偿案件若干问题的规定》规范行政赔偿诉讼受案范围、进一步明确行政赔偿范围和构成要件、规定举证责任倒置的情形并科学划分行政赔偿责任;合理确定“直接损失”范围、进一步明确财产损害赔偿标准、明确人民法院判决给予被征收人的行政赔偿不得少于被征收人依法应当获得的安置补偿权益、完善精神损害赔偿诉讼的规定;进一步明确行政赔偿诉讼原被告主体资格、完善行政赔偿请求时效和起诉期限制度、进一步解决一并及单独提起行政赔偿诉讼程序问题、完善公私法赔偿诉讼的衔接问题;强化法院释明义务,规范对损害赔偿的酌定标准,明确行政赔偿案件的裁判方式。

Provisions of the Supreme People’s Court on Several Issues Concerning the Trial of Administrative Compensation Cases standardizes the scope of administrative compensation litigation, further defines the scope and constituent elements of administrative compensation, provides the inversion of the burden of proof and scientifically divides the administrative liability for compensation. It reasonably determines the scope of “direct loss”, further defines the standard of property damage compensation, clearly stipulates that the administrative compensation awarded by the people’s court to the expropriated person shall not be less than the resettlement compensation rights and interests that the expropriated person should obtain according to law, and improves the provisions on litigation for compensation for mental damage.It further defines the the subject qualification of the plaintiff and the defendant, further improves administrative compensation prosecution of claim and prosecution period,further solves the problem of bringing administrative compensation proceedings together or separately, further improves the connection between public and private law compensation litigation. It strengthens the obligation of court interpretation,regulates the court’s discretionary standard for damages, defines the judgment mode of administrative compensation cases.
