标准与法律融合是现代国家治理中的普遍现象,法律引用标准是标准与法律融合最常见的一种形式。尽管《标准化法》确定了团体标准的法律地位,但我国法律引用标准类型是政府主导制定的国家标准、行业标准、地方标准,暂未见引用团体标准等市场主体制定的标准。如果仅援引政府标准背离我国深化标准化改革发展的方向以及政府负担标准化成本,因此,在国家治理现代化的语境下,有必要探索法律援引团体标准的路径。

The merger of standard and law is a common phenomenon in modern state governance.Legal incorporates standard is the most common form of mer ger of standard and law.Although the"Standardization Law"confirms the legal status of group standards,the types of legal incorporates stan dards in China are national standards,industrial standards and local standards which is developed by the government,and there are no legal example of law incorporates standards which is developed by market entities such as group standards.If only incorporating government standards will go against the direction of deepening standardization reform and our government will bear standardization costs.Therefore,in the context of modernization of national governance,it is necessary to construct the system of legal incorporates group standard.
