规范伦理学视阈下监察官职业伦理制度体系之建构

Construction of Oversight Officials’ Professional Ethics System from the Perspective of Legal Ethics

作为监察权的直接行使者,监察官已成为极具职业特征的法律职业者,其行为活动及职业道德养成亟须专门的职业伦理规范和指引。监察官职业伦理应体现法律职业伦理的基本内涵,还应体现监察工作的治理和反腐倡廉等政治性特征。以此为基础,分别从道德、行为和规范三个层面系统总结提炼监察官职业伦理的基本内涵和制度渊源,并从立法规范、考核机制、监察责任及职业伦理教育等方面,系统构建监察官职业伦理制度体系。监察官职业伦理制度体系是国家监察制度的重要组成部分,与我国腐败治理成效密切相关。

As the direct exerciser of supervision right,the oversight official has become a legal professional with professional characteristics,whose behavior and professional ethics are in urgent need of special professional ethics norms and guidance. The professional ethics of oversight officials should embody the basic connotation of legal professional ethics,and also reflect the political characteristics of supervision work,such as governance and anti-corruption. On this basis,the basic connotation and institutional origin of oversight officials’ professional ethics are systematically summarized and refined from the three levels of morality,behavior and norms,and the system of oversight officials ’ professional ethics is systematically constructed from the aspects of legislative norms,assessment mechanism,supervision responsibility and professional ethics education. The professional ethics system of oversight officials is an important part of the national supervision system,which is closely related to the effectiveness of corruption control in China.
