近年来,比例原则的阶层构造渐次完善,适用结构不断延展,已成为公法领域中的一项基本原则,并逐步彰显和确立自身在私法领域中的地位。党内法规体系是中国特色社会主义法治体系的重要组成部分,其内在目的指向、内在价值立场和外在表现形式皆体现出与比例原则的深度契合性。比例原则应当突破国法体系之畛域,在党内法规体系中广泛适用;比例原则应当作为党内法规体系的一项基本原则存在,其适用能够优化党内法规制定权限配置,提升党内法规制定质量,加强党内法规实施,最终进一步推动党内法规体系的健全与完善。

In recent years,the principle of proportionality has become a basic principle in the public law system,as the hierarchical structure of this principle has been gradually improved and the applicable structure continuously extended.Moreover,the principle of proportion is gradually highlighting and establishing its position in the field of private law such as criminal law and civil law.The inner party regulation system is an important part of the socialist legal system with Chinese characteristics.Its internal purposes,internal value position and external manifestations have all reflected a deep fit with the principle of proportion.The principle of proportion should exist as the basic principle of the inner party regulation system.The application of the principle in the inner party regulation system can optimize the allocation of authority for the formulation of inner party regulations,improve the quality of the formulation of inner party regulations,strengthen the implementation of inner party regulations,and finally further promote the completion and perfection of the inner party regulation system.
