The Contention over the Foundations of the International Order:Rules or International Law

“以规则为基础”的国际秩序之提法源于西方特定的国际政治语境,附带“权力”和“关系”两种特性。中国主张用“以国际法为基础”的国际秩序之概念,其要义在于强调国际法在法律上的应然性,依据“以国际法为基础”的国际秩序所体现的法治精神以及国际法的有关规范性寓意,反对西方国家从国际政治上对规则做出的实然性解读,并对抗其“以规则为基础”的国际秩序内生的国际强权政治逻辑以及对中国实行的规则压制。

The“rules-based”international order has its roots in a specific Western international political context and is characterized by both power and relationships.China advocates the concept of an international order based on international law.Its main point is to emphasize the ideal or de jure nature of international law on the basis of the rule of law spirit embodied in an international order founded on international law as well as the relevant normative implications of international law,and thereby oppose Western countries’de facto interpretation of the rules in terms of international politics and confront the logic of international power politics inherent in their“rulesbased”international order and their“rules-based”oppression of China.
