基于法治主义维度的区块链智能合约发展研究

Research on the Development of Blockchain-based Smart Contract Based on the Rule of Law Dimension

区块链智能合约具有去中心化、自动执行性、匿名性和不可逆性等传统合约所不具备的特征与优势,是提高交易效率、降低交易成本、实现信息共享、推进良善治理等的重要助力。然而,区块链智能合同发展道路并非一帆风顺,受到私人领域与非私领域的不协调发展、去中心化与政府集中监管的矛盾、可逆与不可逆之间的纠葛、信用风险与操作风险的此消彼长等因素的制约。实现区块链智能合约的可持续发展,需要秉持法治主义路径,以实现标准化合约、厘清自由与国家干预边界、引入第三方机制以及探寻风险管控的最优解等方式对区块链智能合同发展的制约因素加以回应。

Blockchain-based smart contract has the characteristics and advantages that traditional contract does not has,such as decentralization,automation,anonymity and irreversibility,which do help to improve transaction efficiency,reduce transaction costs,realize information sharing,and achieve good governance.The development path of blockchain-based smart contract is not smooth,the development of blockchain-based smart contract is restricted by the unbalanced development of private and non-private fields,the contradiction between decentralization and centralized government supervision,the dispute between reversible and irreversible,the elimination of credit risk and operational risk and other factors.To realize the sustainable development of blockchain-based smart contract,it is necessary to uphold the path of rule of law and respond to the bottleneck of the development of blockchain-based smart contract by applying a standardized contract,clarifying the boundary of freedom and national intervention,introducing a third-party mechanism,and exploring the optimal solution of risk control and so on.
