环境资源保护的地方立法:规范、实效与测评——基于陕西省的考察

Local Legislation on the Protection of Environmental Resources:Standardization,Effectiveness and Evaluation

《立法法》修改后,地方国家机关获得环境资源保护领域的地方立法权。在立法实践中合理运用有效测度这项权力,对于发挥地方立法的治理功能有重要意义。针对环境资源保护的地方立法问题,以北大法宝数据库检索信息为依据,对全国和陕西省两个层面的立法成果进行统计归纳,对该领域地方立法的实际效果完成初步评价和反思。这一探索的前提性思考,是对环境资源地方立法权的法律依据和法理正当性进行理论层面的推演、证立。

After the revision of The Legislation Law,local state organs obtain local legislative power in the field of environmental resources and protection,and effectively measure the effectiveness of this power in practice,which is of great value to continue to give full play to the governance function of local legislative power. Aiming at the problem of local legislation on environmental resources and protection,based on the information retrieved by the magic weapon database of Peking University,this paper makes statistics,induction and summary of the legislative achievements at the two levels of the whole country and Shaanxi Province,to complete the preliminary evaluation and reflection on the actual effect of local legislation in this field. The premise of this exploration is the theoretical deduction and justification of the legal basis and legal legitimacy of the local legislative power of environmental resources.
