我国少数民族文化传承版权保护研究综述(2000—2021年)

A Review on Copyright Protection of Ethnic Minority Cultural Inheritance in China (2000—2021)

我国少数民族文化传承版权保护研究大致经历了初始阶段、曲折发展和稳步发展三个阶段。近21年来,围绕民族文化权利主体的确权、权利客体的涵盖范围、权利保护机制、保护期限、传承人及传播者、经营者三者利益分享、保护模式确定等问题,学者们展开了广泛的研究,取得了一系列研究成果。目前,相关研究具有跨学科、实践性强等特点,但也存在研究主题单一、研究方法单一、理论创新不够等不足。下一步,需要进一步拓展研究学科和主题、细化研究方法、创新研究思路,实现民族文化的“自我造血”之路,才能满足保护我国少数民族文化传承版权的现实需要。

The research on copyright protection of cultural inheritance of ethnic groups in China has experienced three stages referred to as the initial stage,the tortuous development stage and the steady development stage.In the past 21 years,scholars in the relevant field have carried out extensive research and achieved a series of research results on such issues as the confirmation of the subject of ethnic cultural rights,the coverage of the object of rights,the protection mechanism,the protection period,the interests sharing between inheritors,disseminators and operators,and the determination of protection modes.Presently,the relevant research has displayed the interdisciplinary and practical characteristics,but such limitations as narrow and limited research topic and method,and insufficient theoretical innovation.In the future research,it is necessary to further expand the research subjects and themes,refine the research methods and bring forth new ideas,so as to realize the“self-hematopoitiveness”of ethnic culture,thus meeting the practical needs of protecting the copyright of cultural inheritance of ethnic minorities in China.
