法律英语教学内容的范式革新--以培养涉外法治人才为目标

On the Paradigmatic Innovation of Legal English Teaching Content——Aiming at the cultivation of foreign-related rule-of-law talents

习近平法治思想提出“统筹推进国内法治和涉外法治”与“建设德才兼备的高素质法治工作队伍”是推进全面依法治国两个方面的要求。对于法学教育而言,法律英语教学是培养涉外法治人才的重要环节。现行法律英语教材主要存在三种体例,分别以部门法为界限、以英美某国法律为主体、以章节难度为次序。这三种常用体例无法满足涉外法治人才所需的“学术型涉外法律能力”与“实践型涉外法律能力”,因而亟待对法律英语教学内容进行革新。法律英语教学应当充分遵循语言学习的规律,从法律英语词汇、语法的特殊性展开,还要舍弃面面俱到的法律介绍,将教学重心转向主要英语国家的法律基础知识,另外需要将我国主要的涉外法律纳入教学范围,尝试“走出去”与“引进来”双轮驱动我国法律英语教学内容的范式革新。

Xi Jinping Thought on the Rule of Law entails two demands for comprehensively promote the law-based governance in China,that is,“to coordinate the promotion of the domestic rule of law and foreign-related rule of law”and“to build a high-quality legal work team with both morality and ability”.As for the legal education,legal English teaching is an indispensable part of cultivating foreign-related legal talents.There are three major modes of the current legal English teaching content and each of them respectively emphasizes on the branches of law,the law in one of certain English-speaking countries,and the sequence of chapters according to their difficulties of the law.According to the author of this paper,the current three modes fail to foster the“academic”and“practical”competences that required by the cultivation of Foreign-related legal talent.Thus,it is urgent to innovate the content of legal English teaching.The new mode of legal English teaching should fully follow the rules of language learning,starting from the particularity of legal English vocabulary and grammar.It should abandon comprehensive legal introduction to the laws,procedures and legislations of English-speaking countries,and then it should shift the focus of teaching content to the basic legal knowledge of English-speaking countries and also should cover Chinese primary foreign-related laws in the scope of teaching content to realize the two-wheel drive of both“going out”and“bringing in”.
