摘要
法理学课程在法学教育中因其高度的理论抽象性与哲学思辨性而与其他部门法课程存在较大差异,也正因如此,法学教育领域对法理学课程教学模式的讨论蔚然成风。但相关的教学科研成果或偏重宏观的理念指引,或强调微观的方法适用,往往未能体系化地构建两者之间的呼应关系。文章从当下对法理学课程教学模式的研究梳理入手,区分教学理念与教学方法两个层次的先行成果,进而以案例辩论模式作为切入点对以上两个层次进行有机结合。最后以“安乐死”议题为例对法律概念这一知识点的课程教学进行分解式的阐释,以期对今后我国法理学课程教学提出有建设性的参考意见。
ion and philosophical speculation.As a result of this characteristic,the discussion on the teaching mode of jurisprudence course has become popular in the field of legal education.However,the relevant research achievements either focus on the general guidance of concepts,or emphasize the application of micro methods,which often fail to build the corresponding relationship between them systematically.Starting from the current research on the teaching mode of jurisprudence course,this paper distinguishes the research achievements of the two levels of teaching concepts and teaching methods,and then organically combines them with the case debate mode as the starting point.Finally,taking euthanasia as an example,this paper interprets the teaching of legal concept,hoping to provide constructive suggestions for the future teaching of jurisprudence in China.
