法国教育法规法典化的经验及启示

On the Experience of Codification of French Education Laws and Its Enlightenment to China

摘要 21世纪初,法国为简化和明确教育法规、稳定教育法治环境颁布了教育法典,该法典在世界教育法规法典化经验中极具代表性,对进一步完善我国教育法制体系有极大的借鉴意义。对《法国教育法典》编纂的背景历程和体系内容进行梳理,可以对其有较为全面的认知,并从中总结其成功编纂主要得益于中央政府的全力支持、丰富的经验技术贡献以及实用主义编纂思路推动。教育法规法典化是推进我国全面依法治教的有利之举,但同时也要正视法典本身的限制,可以在借鉴经验并结合国情的基础上对法典编纂所涉及的价值位阶、内容范围、模式体例等主要问题进行科学规划,充分发挥教育法典的作用。 At the beginning of this century,France formulated the Education Code in order to simplify and clarify education laws and stabilize the legal environment of education.This Code is very representative of the world's experience in codifying education laws and has great reference significance for further improving China's education legal system.To sort out the codification background,process,style and content of the Education Code of France,we can have a more comprehensive understanding of it,and conclude that its successful codification is mainly due to the full support of the central government,rich experience and technical and realistic codification strategy.It is a favorable move to codify education laws to promote the comprehensively managing of education with laws in China,but at the same time,we must face up to the limitations of the Code itself.Drawing on the Education Code of France based on the actual situation of China to make a code codification plan on the value hierarchy,content range and model style,and then give full play to the role of the education code.
