本文结合中华古籍保护计划实施以来相关的政策性文件,以及同古籍保护相关的文物、图书馆、档案、史志、宗教事务等法律法规,对古籍保护立法的合法性作出了分析,对古籍立法可能从其他法规借鉴和区别之处作了辨析,并特别就文化主管部门和公共图书馆在古籍立法中的地位作了探讨。

Based on the relevant policy documents since the implementation of Protection Plan of Ancient Chinese Books,as well as the laws and regulations related to the protection of ancient books,such as cultural relics,libraries,archives,historical records,religious affairs,the paper analyzes the legitimacy of the ancient book protection legislation,discriminates the possible reference and differences of the legislation on ancient books from other laws and regulations,and discusses the positions of cultural authorities and public libraries in the legislation of ancient books in particularly.
