浙江省跨境电商海外知识产权纠纷现状调查——以在美联邦法院诉讼为例

Investigation on the Status of Cross-border E-commerce Overseas Intellectual Property Disputes in Zhejiang Province——Taking Litigation in the US Federal Court as an Example

近年来,随着浙江省跨境电子商务的发展,中美经贸摩擦加剧,浙江省跨境电商的海外知识产权问题日益严峻。数据库统计结果显示,浙江省跨境电商涉美诉讼案件呈现出波及范围广、侵权领域集中、缺席败诉比例高等特点,从侧面反映出浙江省跨境电商知识产权意识薄弱、不适应美国司法体系、知识产权服务相对缺乏等问题。为了帮助浙江省跨境电商防控海外知识产权风险,本文提出了相关对策和建议。首先,提高电商知识产权意识;其次,加强纠纷应对的资金支持;最后,善用数字化技术创新知识产权服务模式。

In recent years,cross-border e-commerce in Zhejiang Province has been developing.However,with the intensification of Sino-US trade frictions,the issue of overseas intellectual property for cross-border e-commerce operator in Zhejiang has become increasingly severe.The database statistical results show that the cases involving the United States of cross-border e-commerce in Zhejiang province are characterized by widely spreading,concentration of infringement areas,and high proportion of absentees.It reflects the weak intellectual property awareness of cross-border e-commerce in Zhejiang province,incompatible with the US judicial system,and lack of intellectual property services.In order to help Zhejiang cross-border e-commerce operators to prevent and control overseas intellectual property risks,this paper puts forward relevant countermeasures and suggestions,it is necessary to improve e-commerce intellectual property rights awareness;then,strengthen financial support for dispute resolution;and innovate intellectual property service models with the help of digital technology.
