行政协议非诉执行制度的审视与完善--以《行政协议司法解释》第24条第2款为对象

Review and Improvement of Non Litigation Enforcement System of Administrative Agreement:Take Paragraph 2 of Article 24 of The Judicial Interpretation of Administrative Agreement as the Object

《行政协议司法解释》第24条第2款规定了以“行政处理决定”为前置程序的行政协议非诉执行制度。而“监督履行职权”属于行政优益权的应有之义,作出“要求履行协议书面决定”或“行政处理决定”属于行政机关自由裁量权范围。《行政协议司法解释》第24条第2款应当与第1款合并为一款。基于行政协议的契约性,作为行政协议非诉执行制度前置程序之一的“行政处理决定”不得独立为行政相对人增设义务。为保障行政相对人合法性程序权利,行政协议非诉执行制度应当确立事前告知制度、说明理由制度与听证制度。

Paragraph 2 of Article 24 of The Judicial Interpretation of Administrative Agreement stipulates the non litigation execution system of administrative agreement with"administrative handling decision"as the pre procedure."Supervising the performance of functions and powers"belongs to the due meaning of the administrative priority right,and making"written de⁃cision to require the performance of the agreement"or"administrative treatment decision"belongs to the discretion of the ad⁃ministrative organ.Paragraph 2 of Article 24 of The Judicial Interpretation of Administrative Agreement shall be combined with paragraph 1 into one paragraph.Based on the contractual nature of the administrative agreement,as one of the pre pro⁃cedures of the non litigation execution system of the administrative agreement,the"administrative processing decision"shall not independently add obligations to the administrative counterpart.In order to protect the legitimate procedural rights of the administrative counterpart,the non litigation execution system of administrative agreement should establish the prior notifica⁃tion system,the explanation system and the hearing system.
