受困的业主自治和失控的市场扩张——由一个“职业物闹”事件引发的探讨 被引量:7

Trapped Homeowners’Self-Governance and Runaway Market Expansion:A Discussion Triggered by a“Troublemaker”Incident in Urban China

摘要 本文以一个商品房社区的“职业物闹”事件为例,探讨社区治理的公共性困境及其产生的机理。案例中,社区外部的物业公司为了扩张市场,通过职业团队、网络动员和谋利型上访等策略“撬盘”。面对此,业主委员会通过自我“检举”、行政诉讼、联名信访和引导舆论等措施“保盘”,基层政府则通过依法行政和依法审判等予以应对。但最终,业主委员会的“保盘”行动失败。在物业市场的恶性竞争、业主自治的实践偏差和依法治理的实践悖论等社区外部因素,以及能力的结构性失衡和共同体意识缺席等社区内部因素共同作用下,业主自治陷入困境。因此,应当进一步营造良性的物业市场竞争环境,完善业主自治制度建设,发挥党建在社区治理的引领作用。 Through investigating a“troublemaker”incident in Urban China,this article discusses the public dilemma of neighborhood governance.In this case,property management companies outside the community expanded the market through professional teams,online mobilization,and profit-oriented petitions.Faced with this,the homeowners’committee resisted through self-reporting,administrative litigation,joint petitions,and guidance of public opinion.The local government responded by exercising administration according to law.In the end,the homeowners’committee’s resistance action failed.Under the combined influence of external and internal factors,homeowners’self-governance fell into a trapped situation.Therefore,neighborhood governance should further create a benign environment for the property management market competition,improve the construction of homeowners’self-governance system,and enable the party organization to play a leading role.
