法律的强制性是法律的根本属性,但学者们对于法律强制性有没有差异的问题,则一直语焉不详。法律强制性差异是指,由于不同原因,在同一法律体系或同一部法律中,不同法律规范具有程度不同的强制性,甚至存在没有强制性的法律规范。法律强制性以惩罚和制裁为主要手段,是法律规范的基本属性。法律强制性差异主要体现在强制力度、时空范围等方面,可分为允许的强制性差异和不允许的强制性差异,不同类型的强制性差异会影响法律实施效果。

The compulsory nature of law is a fundamental attribute of law,but scholars have been silent on the question of whether there are differences in the compulsory nature of law.The difference in legal compulsion refers to the fact that,for different reasons,different laws within the same legal system,different legal norms within the same law,have different degrees of compulsion,or even the existence of legal norms that are not compulsory.The differences in legal compulsion are both an objective phenomenon and a subject worthy of in-depth study because a full understanding of such differences can help the deepening and development of jurisprudential understanding.To this end,the author successively explains legal compulsion,the manifestations of legal compulsion differences and their attributes,the key factors that distinguish legal compulsion differences,and some of the causes that influence legal compulsion differences.
