后疫情时代国际格局加速演变,单边主义、贸易保护主义上升。美中竞争对抗加剧,美中贸易摩擦涉知识产权争端持续升温,我国涉337调查案件量居高不下,被调查企业常常处于非常不利的被动地位。本文从我国涉美国337调查现状出发,通过详细解剖我国企业应对337-TA-800案件的过程和胜诉策略,分析企业遭遇337调查的应对策略。提出重视企业自主创新、加强出口前侵权风险评估、多策略积极应对337调查和善用国内行政和司法程序进行反击等措施建议,防范我国企业海外知识产权风险和诉讼纠纷。

In the post-epidemic era,the international landscape is evolving rapidly,and unilateralism and trade protectionism are on the rise.The competition and confrontation between the United States and China have intensified,and the US-China trade frictions and intellectual property disputes have continued to heat up.The number of 337 investigation cases in my country remains high,and the companies under investigation are often in a very unfavorable passive position.Starting from the current situation of my country's 337 investigations involving the United States,this paper analyzes the response strategies of enterprises encountered 337 investigations through a detailed analysis of the process and winning strategies of Chinese enterprises in responding to 337-TA-800 cases.Put forward measures such as attaching importance to independent innovation of enterprises,strengthening pre-export infringement risk assessment,actively responding to 337 investigations with multiple strategies,and making good use of domestic administrative and judicial procedures to counterattack,so as to prevent Chinese enterprises from overseas intellectual property risks and litigation disputes.
