长阳土家族自治县农产品地理标志法律保护研究

Research on Legal Protection of Agricultural Product Geographical Indications in Changyang Tujia Autonomous County

农产品地理标志无论是在知识产权领域,还是在农业领域都具有重要地位,具有经济价值、文化价值、社会价值和生态价值,对农产品地理标志进行法律保护具有必要性。本文通过对长阳土家族自治县农产品地理标志的实证研究,分析我国农产品地理标志的法律保护模式和长阳土家族自治县农产品地理标志的法律保护现状,挖掘背后存在的农产品地理标志在注册、使用、保护、监管四个方面的法律保障困境,并提出专门立法、优化管理机制、加大投入宣传、简化执法程序等保障对策。

Geographical indications of agricultural products have an important position in the field of intellectual property rights and agriculture.They have economic value,cultural value,social value and ecological value.Legal protection of geographical indications of agricultural products is necessary.Through the empirical research on the geographical indications of agricultural products in Changyang Tujia Autonomous County,this paper analyzes the legal protection mode of agricultural geographical indications in my country and the legal protection status of agricultural geographical indications in Changyang Tujia Autonomous County,and explores the existence of agricultural geographical indications in registration,use,protection,Supervise the legal protection dilemma in four aspects,and put forward special legislation,optimize the management mechanism,increase investment in publicity,and simplify law enforcement procedures.
