重大疫情防控中个人信息的法律保护

Legal Protection of Personal Information in the Prevention and Control of Major Epidemics

在数字经济时代,个人信息的战略价值日益凸显,而在以新冠肺炎疫情为代表的重大疫情防控中,个人信息的收集与使用既有助于我国建立联防联控系统,又有利于构建安全有效的公共卫生体系。然而有报道显示,不必要的侵害个人信息权益的行为时有发生,公众在登记个人信息的同时难免有所顾虑。如此应明确处理二者关系基本原则的位序,构建个人信息公开的标准与界限,建立个人信息保护与利用的风险管理机制,实现个人信息权益保护与利用的平衡,在法治轨道上统筹推进各项疫情防控工作顺利进行。

In the major epidemic prevention and control efforts represented by COVID-19,the strategic value of personal information has been gradually highlighted,which contributes to the establishment of China’s joint prevention and control system and the construction of the safe and effective public health system.However in the process of collecting personal information,some reports show unnecessary violations of personal information occur,and it is inevitable that citizens have worries when having their personal information registered.So,it is proposed to achieve a balance between personal information protection and use,clarifying the order of handling their relationship,to build a standard and limit of personal information disclosure,to establish a risk management mechanism of protecting and utilizing personal information,so that the epidemic prevention and control will be smoothly implemented in accordance with the rule of law.
