“法律与文学”对于法律史研究的意义——以《孔雀东南飞》的研究成果为例

The Significance of “Law and Literature” to the Study of Legal History:Take the Research Results of Peacock Flying Southeast as an Example

“法律与文学”自引入我国以来一直颇受法学界的推崇,纯粹理论性的研究成果与结合具体文本的研究成果层出不穷,但这些成果价值几何是值得掂量的。以对《孔雀东南飞》这一历史文本的研究为例,现有的研究成果几乎全部集中在古代婚姻家庭制度上,然而法律史学界对于我国古代婚姻家庭制度的研究已经相当深入,运用“法律与文学”的方法所得出的结论与已有的结论并无不同,那么“法律与文学”对于法律史研究还有什么意义?如果“法律与文学”只是单纯地借用新鲜的材料而不管结论的新旧,那么文章的创新性何在,学科(领域)的未来发展方向何在?这些都是“法律与文学”须要回答的问题,同时也是“法律与文学”将给法律史研究指明的新出路所在。

“Law and Literature” has been highly respected by the legal circles since it was introduced into our country.Pure theoretical research results and research results combined with specific texts have emerged one after another,but the value of these results is worth weighing.Taking the research on the historical text of Peacock Flying Southeast as an example,almost all existing research results focus on the ancient marriage and family system.However,the legal historian has already done in-depth research on the ancient marriage and family system in china.The conclusion drawn by the method of “and literature” is not any different from the existing conclusions,so what significance does “law and literature” have for the study of legal history?If “Law and Literature” simply borrows fresh materials regardless of the new and old conclusions,what is the innovative nature of the article and the future development direction of the discipline (field)?These are all questions that “Law and Literature” needs to answer,and at the same time,“Law and Literature” will point out new ways for the study of legal history.
