Case Guidance System’s Inheritance and Reconstruction of Traditional Precedent System

案例指导制度作为我国司法改革的热点,深受我国传统判例文化影响:形式上,指导性案件的公开发布以其中央权威性为出发点;功能上,成文法的辅助工具为指导性案例;方法上,指导性案件的具体适用规律也存在缺位。与此相对,案例指导制度也从传统判例文化的传承中得以重构:形式层面,报全国人大常委会备案形成监督制约;功能层面,重视法官归纳推理能力的培养;方法层面,设置程序性保障措施。

The case guidance system is deeply influenced by China’s traditional precedent culture.In form,the public release of guiding cases is based on its central authority.Functionally,the auxiliary tool of the statutory law is the guiding case.In the method,the specific application law of the guiding case is also absent.In contrast,the case guidance system has also been reconstructed from the inheritance of the traditional precedent culture:at the formal level,reporting to the Standing Committee of the National People’s Congress to form supervision and restriction;at the functional level,attaching importance to the cultivation of judges’inductive reasoning ability;at the method level,setting up procedural guarantees measures.
