摘要
安全生产行政公益诉讼可以有效解决安全生产领域行政监管的短板,目前检察机关已开展大量安全生产行政公益诉讼的实践,但出现了“野蛮生长”的趋势。结合检察机关介入安全生产领域的优势和劣势,可以总结出安全生产行政公益诉讼的启动目的、判断标准等具有特殊性。检察机关启动安全生产行政公益诉讼时必须尊重行政机关的首次处理权、明晰安全生产公共利益的范围,建立科学合理的案件筛选机制。在具体制度构建上,应当根据安全生产行政公益诉讼两个不同阶段的特征设置相应的启动条件。
Work safety administrative public interest litigation can effectively solve the shortcomings of administrative supervision in the field of work safety.At present,procuratorial organs have carried out a large number of work safety administrative public interest litigation practice,but there is a trend of“barbaric growth”.Combined with the advantages and disadvantages of procuratorial organs involved in the field of work safety,it can be concluded that the starting purpose and judgment criteria of work safety administrative public interest litigation have particularity.When starting work safety administrative public interest litigation,procuratorial organs must respect the first handling power of administrative organs,clarify the scope of work safety public interests,and establish a scientific and reasonable case screening mechanism.In the specific system construction,the corresponding starting conditions should be set according to the characteristics of the two different stages of work safety administrative public interest litigation.
