司法裁判的社会功能失灵及其应对——基于社会价值之反向重塑的思考

The Social Function Failure of Judicial Adjudication and Countermeasures——Thinking Based on the Reverse Reconstruction of Social Value

司法裁判的社会功能之体现在于以公正司法引领社会公正并以此实现社会公平正义的终极目标,而且,社会功能的有效发挥与裁判结果的可接受性乃至其法律效果与社会效果之统一的实现皆密切相关。随着作为社会价值共识且本质上可与司法裁判相互融贯的社会主义核心价值观的提出与援引,为司法裁判之社会功能的有力彰显提供了时代契机,只是由于司法实践中对于核心价值观的运用失范,导致适用效果不如预期,理应从价值层面与规则层面两个角度,分别对核心价值观的具体内涵予以明确,对裁判理念、裁判规则、裁判说理予以规范。

The social function of judicial adjudication is to lead social justice with fair administration of justice so as to realize the ultimate goal of social fairness and justice.Moreover,the effective exertion of social function is closely related to the acceptability of the adjudication result and the realization of the unity of its legal effect and social effect.With the proposal and invocation of socialist core values as a consensus of social values and essentially integrated with judicial adjudication,it provides an opportunity of the times for the powerful manifestation of the social function of judicial adjudication.However,due to the anomie of the application of core values in judicial practice,the application effect is not as good as expected.We should clarify the specific connotation of core values from the perspectives of value and rules and standardize the judicial concept,judicial rules and judicial reasoning.
