司法改革背景下检察辅助人员管理模式探索

检察人员分类管理改革的顶层设计中并未明确检察辅助人员的具体管理模式。检察辅助人员分类管理制度的运行中,各类辅助人员混同、权责不清、身份定位模糊等现象十分普遍。究其原因,在于没有遵守司法规律反而沿袭了普通公务员以“人”为中心的单一化、行政化管理模式所致。在优化检察资源配置改革背景下,人员的分类不是改革的目的仅是手段,各类型辅助人员的职业化队伍的建设才是改革目的。因此,检察辅助人员的管理模式应以职位分类为基础,进行横向和纵向的人员和职责的配置,并在此基础上构建由完整检察权、有限检察权、纯检察事务阶梯式的职权配置模式。

The top-level design of the classified management reform of procuratorial personnel does not clarify the specific management mode of procuratorial assistants.In the operation of the classified management system of procuratorial assistants, it is very common that all kinds of assistants are mixed up, whose powers and responsibilities are unclear, and identities are ambiguous.The reason is that, instead of abiding by the law of justice, it follows the single and administrative management mode of ordinary civil servants centered on “people”.Under the background of optimizing the allocation of procuratorial resources, the classification of personnel is not the purpose of the reform but only a means, and the construction of professional teams of various types of auxiliary personnel is the purpose of the reform.Therefore, the management mode of procuratorial assistants should be based on the classification of positions, so that the personnel and responsibilities should be allocated horizontally and vertically, and on this basis, a hierarchical power allocation mode consisting of complete procuratorial power, limited procuratorial power and pure procuratorial affairs should be constructed.
