智慧法院建设是审判体系和审判能力现代化的重要抓手。人工智能技术在诉讼服务和司法裁判领域的广泛应用,为司法审判的信息化和智能化带来了新的机遇和挑战。在刑事审判中,人工智能可以配合量刑规范化改革,辅助法官量刑,提高司法效率。但人工智能自身存在的算法所需数据提取的困难、潜在的算法歧视和偏见以及算法缺乏透明度等潜在风险,需要通过建立统一的司法数据库、完善个人信息保护法和算法司法审查制度、构建完备的算法监管与公开机制等路径加以规避和应对,以确保人工智能辅助量刑系统安全、有序的健康发展。

The construction of smart courts is an important starting point for the modernization of the judicial system and judicial capacity.The extensive application of artificial intelligence(AI) technology in the field of litigation services and judicial adjudication has brought new opportunities and challenges to the informatization and intelligence of judicial adjudication.In criminal trials, AI can cooperate with the standardization reform of sentencing, assist judges in sentencing and improve judicial efficiency.However, for the potential risks exist in AI,such as the difficulties of data extraction, potential algorithm discrimination and prejudice, and lack of transparency of algorithms, it is necessary to establish a unified judicial database, improve the personal information protection law and judicial review system for algorithm, and build a complete system for algorithmic supervision and disclosure mechanisms to avoid and dealt with, to ensure the safe, orderly and healthy development of the AI-assisted sentencing system.
