公共交通上的“性骚扰”:缘起、困境与治理路径选择

近年来,部分城市公共交通领域性骚扰问题频发,乘车秩序受到严重破坏。但囿于警力有限、受害人报警意愿不足,定罪处罚难度较大等因素,性骚扰问题的治理效果并不理想。在体制内外力量的推动下,广州、上海等地公安机关创新犯罪侦查手段,有力支撑了刑事判决的率先破局。在常态化防控方面,专业警种以专项行动打击形式,重点整治问题突出的交通路线,切实维护公交乘车秩序。但公共交通领域性骚扰问题的最终解决,需发挥立法的顶层设计作用、加大司法对弱者权益的保护力度、强化公共交通承运人的责任、积极宣传营造文明乘车环境、发挥群团组织共同参与的合作机制等措施综合应对。

In recent years,sexual harassment has occurred frequently in the public transport sector in some cities,and the traffic order has been severely damaged.However,due to factors such as limited police force,insufficient voluntary reporting by victims,and difficulty in convicting and punishing,the governance effect of sexual harassment is not ideal.Driven by forces inside and outside the system,public security organs in Guangzhou,Shanghai and other places have innovated criminal investigation methods,which strongly support the first break in criminal judgments.In terms of normalized prevention and control,different police departments focus on rectifying traffic routes with prominent problems in the form of special action strikes,and effectively maintain the order of public transportation.However,the final solution to the problem of sexual harassment in the field of public transportation depends on the integration of the top-level design of legislation,strengthening the protection of the rights and interests of the weak by the judiciary,fulfilling the responsibility of public transportation carriers,publicizing and creating a civilized traffic environment,giving full play to the participation of groups and organizations and other measures.
