疫情防控背景下警务执法风险的形成与防范研究

Research on the Formation and Prevention of Police Law Enforcement Risk under the Background of Epidemic Prevention and Control

疫情防控是重要的社会治理活动,警察要承担相应的社会职责。疫情也给警察警务执法带来了更大的风险。运用文献法、逻辑分析法等研究方法,对疫情防控背景下警察警务执法风险源和形成路径进行了分析。研究发现:执法对象行为、警察自身不当执法行为、执法装备的配置、舆情导向的偏颇等都会为执法带来风险。防范风险必须遵循沟通优先与武力适度相结合、尊重人权与保护公权益相结合、履行职责与安全防护相结合等原则。提出强化战时动员、推行现场讲话、安全使用武力、全面配置装备、加强舆情反制等具体的防范路径与措施。

Epidemic prevention and control is an important social governance activity,the police should assume the corresponding social responsibilities.The outbreak also poses a greater risk to police enforcement.By using the methods of literature and logic analysis,this paper analyzes the sources and formation paths of police law enforcement risks under epidemic prevention and control.The study finds that the behavior of law enforcement objects,the improper behavior of police themselves,the disposition of law enforcement equipment and the bias of public opinion will bring risks to law enforcement.At the same time,it finds that to prevent risks,we must follow the principles of combining communication priority with appropriate force;combining respecting human rights with protecting public rights and interests;and combining duty performance with security protection.At last,the paper puts forward specific preventive measures such as strengthening wartime mobilization,promoting on-the-spot speech,using force safely,collocating equipment in an all-round way,and strengthening public opinion counter-reaction.
