欧盟“阻断法案”在美国法院的适用及其启示

The Application of The Blocking Statue of EU in American Courts and Its Enlightenment

与一般的国内法不同,阻断法案的功能实现需要外国法院的承认与适用。欧盟“阻断法案”是世界上最早的以阻断外国法律、法规在域内产生效力而应对美国国内法不当域外适用法案。美国法院承认欧盟“阻断法案”存在的事实,并在各类案件中采用国际礼让原则下的多要素分析法适用此类法案。我国新颁布的《阻断外国法律与措施不当域外适用办法》标志着我国阻断法案的发展迈入新阶段。借此契机,我们可以借鉴欧盟“阻断法案”在美国法院适用的经验,积极利用我国的阻断法案,扩大我国阻断法案的域外影响力。

Different from general domestic laws,the realization of the function of The Blocking Statue requires the recognition and application of foreign courts.The EU is the first one in the world to pass The Blocking Statue to respond to the improper extraterritorial application of US domestic laws.The U.S.courts recognize the existence of The Blocking Statue of EU and adopt the multi-factor analysis method under the principle of international comity to apply those statues in various cases.China newly promulgated the “Act to Block the Improper Extraterritorial Application of Foreign Laws and Measures”.It marks a new stage in the development of the blocking statue in China.Taking this opportunity,we can learn from the experience of the EU’s The Blocking Statue in the US courts,and actively use China’s blocking statue to expand its extraterritorial influence.
