刷脸识别中的技术伦理检视及法律规制

刷脸识别技术在识别人脸层面的巨大优势,使得其应用场景囊括政府层面和非政府层面,且安全、便捷与信任传递的应用价值得到普遍认可。然而,技术社会中人的角色在被不断弱化,技术与社会间的双向促进却在一定维度上减损了人的主体性。刷脸识别因涉及人脸的分析使得构建体系不能止于纯粹的法学思考,需要技术伦理视角的引入。其中,刷脸识别在技术伦理层面的挑战大致表现为技术至上主义对人性认知的冲击,与互联网发展异态相耦合,及人类社群与技术社群的颉颃。鉴于此,关于刷脸识别中的技术伦理审视及规制,应从刷脸识别的理论支持层面出发,进而探索出符合同一与差异的辩证规制原理,明确人脸识别技术的使用边界以及强化政府监管责任的中国模式。

The huge advantage of face recognition technology in recognizing faces makes its application scenarios include government and non-government levels,and the application value of safe,convenient and trustworthy transmission is generally recognized.However,the role of human beings in technological society is constantly being weakened,and the two-way promotion between technology and society detracts from human subjectivity in a certain dimension.Face recognition involves the analysis of human faces,so the construction of the system cannot be limited to pure legal thinking and requires the introduction of a technical ethics perspective.Among them,the challenges of face recognition at the technical ethics level are generally manifested in the impact of technology supremacy on human cognition,coupled with the abnormal development of the Internet,and the relationship between the human community and the technical community.In view of this,regarding the technical ethics review and regulation in face recognition,we should proceed from the theoretical support level of face recognition,and then explore a Chinese mode that the principles of dialectical regulation that conform to the sameness and differences,clarify the use boundaries of face recognition technology,and strengthen government supervision responsibility.
