电信网络诈骗是一种有别于传统诈骗犯罪的新型犯罪行为,又称为“虚假信息诈骗”“通信诈骗”或“网络诈骗”,同时也被形象地称为“钓鱼诈骗”。在司法实践中,电信网络诈骗犯罪呈现出取证难、缴赃难、定性难、惩治难的特点。针对这些治理疑难点,应当加强刑事司法体系建设,营造良好司法氛围;健全电信诈骗法律法规,营造良好法治环境;构建社会联动作战体系,提升联合作战能力;提升防控技术水平,加强自身硬实力;加大宣传力度,营造良好社会氛围。

Telecom network fraud is a new criminal act different from the traditional fraud crime.It is also known as“false information fraud”,“communication fraud”or“network fraud”.At the same time,it is also vividly known as“phishing fraud”.The bamboo shoots after a spring rain get out of hand in the whole country,because of the low cost of crime,the weak awareness of the public,the lack of legislative regulation,the anomie of industry regulation and the influence of COVID-19,the crime of“Internet fraud”has been repeatedly banned and repeated.In the process of judicial practice,the crime of telecom network fraud is characterized by difficulties in obtaining evidence,paying stolen goods,determining the nature and punishing.In view of these difficult points,we should strengthen the construction of criminal justice system and create a good judicial atmosphere;Improve the laws and regulations on telecommunications fraud and create a good legal environment;Build a social linkage combat system and improve joint combat capability;Improve the level of prevention and control technology and strengthen their own hard power;Strengthen publicity and create a good social atmosphere;Strengthen international cooperation and improve the governance capacity of telecom network fraud.
