疫情常态化背景下陪护制度研究

疫情防控逐渐进入常态化,卫生健康行政部门先后出台了一系列防控措施,其颁布的“一人一陪护”制度在实施过程中较好地发挥了疫情防控之制度功效,为疫情防控常态化提供了制度保障。但通过对四川某医院调研发现,该制度却出现了立法预期的“负面效应”,陪护不到位、安全事故频发成为该制度进一步优化的着力点和落脚点。为了实现疫情防控与公民健康权保护的制度效用,应当解决陪护制度的原则性和粗放性。家庭亲友陪护人数过于受限,导致医疗机构的陪护资源异常紧张、无法满足患者需求及侵害患者及近亲属知情同意权等问题。应当通过完善陪护制度、规范护工市场的监管以及保障患者及其近亲属的知情同意权等措施予以纠正和调适。

The epidemic prevention and control has gradually entered the normalization,and the situation of prevention and control has become increasingly tense.According to the document requirements of the Commission of Health,a series of prevention and control measures have been introduced.The"one person,one escort"system promulgated by the Commission of Health has played a better role in the implementation of the epidemic prevention and control system,providing a system guarantee for the normalization of epidemic prevention and control.However,through the investigation of a hospital in Sichuan Province,it is found that the system has a"negative effect"expected by the legislation.The inadequate accompanying and frequent safety accidents become the focus and foothold of further optimization of the system.In order to achieve the effectiveness of epidemic prevention and control and the protection of citizens’right to health,we should solve the following problems:the principle and extensive of accompanying system,the limited number of family relatives and friends accompanying,the shortage of accompanying resources in medical institutions,the inability to meet the needs of patients and the infringement of informed consent rights of patients and close relatives.It should be corrected and adjusted by improving the accompanying system,standardizing the market of nursing workers and protecting the right of informed consent of patients and close relatives.
